lost property 遗失物 指由于物之所有人的疏忽或粗心而并非自愿地使其物与所有人分离,并且不知物在何处。不包括所有人为安全起见有意将物藏匿于一个秘密地方。它与遗忘物〔mislaid property〕或抛弃物〔abandoned property〕不同。遗忘物是指物的所有人故意将该物置于某处,事后遗忘其放于何处,但可通过仔细查寻发现该物;抛弃物则是所有人明知而故意放弃该物的利益。遗失物如被找到,真正占有人可继续对该物享有最充分的权利,并确立其占有权。遗失物的拾得人亦享有最充分的权利,并可对抗除真正占有人以外的一切人,但如其知道谁是真正占有人,则应将该拾得物返还,如其不知,则应将拾得物送交警察或失物招领处。 (→mislaid property)
